Judge Blocks Alabama Nitrogen Gas Execution
A US judge has stopped Alabama from executing Jeffery Lee with nitrogen gas. Judge Emily Marks ruled the method breaks the ban on cruel and unusual punishment.
An appeals court had reversed her earlier ruling that the method was allowed. She then issued a permanent block on using nitrogen gas for Lee's execution.
Alabama can still execute Lee using other legal methods. These include lethal injection or electrocution.
Judge Marks also ruled Alabama could use a firing squad. She found it was possible and far less harmful.
Lee's execution had been set for Thursday June 11 2026. Alabama's Attorney General is reviewing the decision.
He is also considering an appeal. The case could reach the US Supreme Court.
Klear Note — Nitrogen gas is a new execution method Alabama tried to use. The US Constitution bans cruel and unusual punishment. Courts must decide if new methods are too painful.
