US Supreme Court to Hear Trump Immigration Detention Case

The US Supreme Court agreed to review Trump's detention policy. The policy requires detention without bond hearings during immigration cases.

It covers immigrants who crossed the border illegally years ago. The case involves Ricardo Aparecido Barbosa da Cunha.

He is a Brazilian citizen arrested in September 2025. His lawyers say he has no criminal charges or convictions.

So the case goes beyond bond hearings for noncitizens with criminal records. The justices will decide if the policy is legal.

They will decide if people facing deportation can be held indefinitely. This applies while courts decide their cases.

The Court will also decide if noncitizens with criminal records get bond hearings after long detention. Most appeals courts rejected the policy.

The 5th and 8th Circuits upheld it. The administration says the split disrupts immigration enforcement. Most noncitizens arrested away from the border once could request bond hearings.

Klear Note — Bond hearings let detained people ask for release during their cases.
